Terms of Service

1. What AutoSummons is — and is not
AutoSummons is a software platform that helps plaintiffs and their counsel request waivers of service of a summons under Federal Rule of Civil Procedure 4(d): it prepares the official AO 398 and AO 399 forms from information you provide, delivers your request and case documents to the recipient through a secure link, collects the recipient's electronic signature if they choose to waive, and maintains an evidence record of the exchange.
AutoSummons is not a law firm, does not provide legal advice, and is not a process server. Using AutoSummons does not create an attorney–client relationship. Whether waiver of service is appropriate for your case, and every other legal decision, is yours (or your counsel's) alone.
2. Your responsibilities
You are responsible for the accuracy of everything you submit — the court, case number, caption, party names, recipient contact details, and the documents you upload. The forms we generate carry your information onto official court forms; errors are your errors. You represent that you are a party (or authorized representative of a party) to the court matter identified, that your use relates to a genuine legal proceeding, and that you will not use the service to harass, deceive, or contact anyone without a legitimate procedural basis.
3. Recipients and electronic signatures
Recipients are never charged and never need an account. A recipient who signs electronically does so under the ESIGN Act and UETA after an explicit consent step; the executed waiver and its certificate of completion record that consent, the signature, and technical metadata. A recipient who prefers paper may download the waiver form and return it outside the platform, or decline.
4. Fees and payment
Pricing is shown before checkout — currently $10.00 per recipient, delivered by email. Payment is processed by Stripe; we do not store card numbers. Fees are charged when you place an order and are refundable at our discretion where a request could not be delivered (contact us). Sending a request requires a paid order covering it.
5. The evidence record
The point of the service is a reliable record: delivery events, link opens, document views, and signatures are logged with timestamps and technical metadata in a tamper-evident audit log, and provided to you as the Service Engagement Report. You are responsible for how you use that record in any proceeding.
6. Acceptable use
Do not upload malicious files or content you lack rights to; do not misrepresent your identity or authority; do not attempt to access other users' data or interfere with the service. We may suspend accounts that violate these terms or that providers flag for abuse.
7. Disclaimers and limitation of liability
The service is provided "as is" without warranties of any kind. Deadlines under Rule 4(d) are computed from your inputs and the record; verifying them against the rules and any court orders is your responsibility. To the maximum extent permitted by law, our total liability for any claim arising out of the service is limited to the fees you paid us in the twelve months before the claim arose; we are not liable for indirect or consequential damages, including the outcome of any legal proceeding.
8. Changes and contact
